Terms and Conditions

1. Products and Services

1.1 Validity

  • Prices quoted are valid and fixed for thirty (30) days only.
  • Product availability is subject to change. If a quoted product is unavailable on the event day, it will be replaced with a product of equal value and quality.
  • Display content may vary based on on-site conditions to comply with State Regulations. No refunds will be issued for necessary substitutions or omissions.
  • As per current legislation, the client contracts Skylighter Fireworks Pty Ltd for a service, not a product. All fireworks products remain the property of Skylighter Fireworks Pty Ltd at all times.

2. Safety and Public Issues

  • Skylighter Fireworks staff will determine the safe public viewing area for the display.
  • The client is responsible for:
    • Monitoring patron behaviour at the venue.
    • Providing crowd control, security, and safety fencing before, during, and after the display.
  • Preventing unauthorised access to Skylighter’s equipment before, during, and after the event.
  • The event organiser must obtain landowner permission for the fireworks display site at least 14 days before the event. By completing the booking form; landowner consent is confirmed.
  • The organiser must notify surrounding residents and businesses at least 3 days prior to the event. Skylighter can provide this service for an additional fee.
  • Any product malfunctions or client dissatisfaction must be reported at the time of event or within 24 hours to the Display Manager or Skylighter Fireworks Head Office.

3. Insurance

  • Skylighter Fireworks holds $20 million in Public Liability Insurance.
  • Any specific insurance indemnifications must be requested at least 14 days before the event.

4. Scripted Event Activations with Musical Soundtracks

  • The client must submit the Skylighter Fireworks Online Booking Form at least 40 days before the event.
  • The client must:
    • Provide a pre-approved soundtrack or
    • Approve Skylighter’s soundtrack at least 30 days before the event.
  • If the client does not meet these deadlines, Skylighter will finalise the soundtrack independently, and no further client input will be accepted.
  • The client is responsible for obtaining any necessary APRA and/or AMCOS music licences for their event.

5. Payment Schedule and Terms

5.1 Deposit

  • Submitting the Online Booking Form generates an invoice for a 50% non-refundable deposit, securing the event date.
  • The event will only be scheduled after the deposit is received.

5.2 Remaining Balance

  • The remaining balance is due no later than 30 days before the event.
  • Events booked within 4 weeks of the event date require full payment upon booking.
  • If payment is not received by the due date, Skylighter may cancel the display unless alternative arrangements are agreed upon.
  • Invoices unpaid for more than 30 days after the due date may incur a 5% late fee on the outstanding balance, compounded monthly. This fee will continue to accrue until the balance is paid in full.

6. Postponement and Cancellations

6.1 Postponement

  • If the event cannot proceed due to unsafe weather conditions, both parties may agree to postpone or cancel as per the cancellation fee schedule below.
  • Postponement requests must be in writing, and the new date must be mutually agreed upon.

6.2 Cancellations by the Client

  • More than 14 days (for projects booked on account/post-event invoice): A $250.00 cancellation fee applies. Plus invoice for works completed.
  • More than 14 days: Skylighter retains or invoices the 50% non-refundable deposit.
  • Less than 14 days: Skylighter retains or invoices the 50% deposit and invoices for any additional costs incurred.
  • Less the 7 Days: 75% of the event cost are applicable and invoices for any additional costs incurred.
  • Less than 48 hours: Skylighter retains 100% of the event cost and invoices for any additional dismantling costs.
  • If third-party services (e.g., barge hire, security services) were booked, the client must pay all subcontractor costs in full within 7 days of cancellation.
  • Any event credit notices issued as a result of event postponement must be used within 365 days of original event day.

6.3 Cancellations by Skylighter

Skylighter reserves the right to cancel a display prior to or during the event due to:

  • Public safety concerns (e.g., security breaches).
  • Product malfunctions.
  • Unsafe weather conditions.

6.4 Standard Billing Terms

Unless otherwise agreed upon Skylighter’s payment terms are as follows:

For Events More than 30 Days Out:

  • Deposit Invoice – 50% of the total project value, due immediately upon booking.
  • Balance Invoice – 50% of the total project value, due 30 days prior to the event date.

For Events Booked Within 30 Days of the Event:

  • Full Balance Invoice for 100% of the project value.
  • The invoice due date is set due immediately with payment prior to event delivery

7. Use of Event Imagery & Marketing

Skylighter Fireworks may use any photos, videos, or recordings of the event for promotional and marketing purposes unless otherwise agreed in writing.

8. Exclusions & Disclaimer

Skylighter will not be liable for:

  • Misuse of hired equipment.
  • Cleaning fees before or after the fireworks display.
  • Damage due to unforeseen human intervention or natural disasters.
  • Costs from fire alarms related to the display.
  • Any injuries to people or animals caused by the noise or effects of the display.
  • Costs from events running overtime, including $100.00 + GST per hour per technician for delayed site access or egress.

9. Clean-up & Safety Services

  • After the display, Skylighter will sweep the site and remove any unfired pyrotechnics.
  • Some non hazardous debris (e.g., small paper and cardboard fragments) may remain. Skylighter is not liable for clean-up costs.

10. Example Videos & Illustrative Images

All example videos and images are for illustrative purposes only. Actual displays may differ due to product availability and safety considerations.

11. Client Portal & Compliance Onboarding Fees

  • If the client requires Skylighter Fireworks to onboard onto a third-party payment portal, risk management system, compliance platform, or similar service, any associated fees, administrative costs, or additional labour required will be invoiced to the client for payment in full.
  • Skylighter reserves the right to decline onboarding if the platform’s requirements are deemed unreasonably complex, time-consuming, or cost-prohibitive.

12. Confidentiality & Non-Disclosure Agreement

  • By receiving a quote from Skylighter Fireworks, whether the event is booked or not, the client agrees to adhere to Skylighter’s Non-Disclosure Agreement (NDA), which is available at skylighter.com.au/nda.
  • This includes, but is not limited to, the confidentiality of pricing, technical details, show designs, and any proprietary information provided in the quote or associated documents.
    Any unauthorised sharing, reproduction, or distribution of Skylighter’s confidential information may result in legal action.

13. Client Responsibilities

The client is responsible for:

  • Obtaining any necessary APRA and/or AMCOS music licences for their event.
  • Monitoring patron behaviour at the venue.
  • Providing crowd control, security, and safety fencing before, during, and after the display.
  • Preventing unauthorised access to Skylighter’s equipment before, during, and after the event.
  • Ensuring permission for use of the activation site unless otherwise agreed that Skylighter will obtain this directly.
  • Ensuring they understand and comply with stage regulations as an event organiser of a fireworks display.
